Tokogame.com Terms & Conditions

General

• By registering and/or using the Tokogame.com Services, Users automatically agree to all terms of the Tokogame.com Services.
• These Terms of Use govern the use of all Services available on the Tokogame.com System, applicable to all Users and any party submitting requests or information to Tokogame.com. By registering an account on Tokogame.com and/or using the Tokogame.com System, Users are deemed to have read, understood, and agreed to all contents of these Terms of Use.
• These Terms of Use may be amended, modified, added to, removed, or changed at any time in accordance with the development of Tokogame.com and applicable laws and regulations. We encourage Users to periodically visit the Tokogame.com System to stay informed of any such changes.
• THESE TERMS OF USE CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN THE USER AND TOKOGAME.COM. USERS KNOWINGLY AND VOLUNTARILY AGREE TO THESE TERMS TO USE THE SERVICES ON THE TOKOGAME.COM SYSTEM.

Definitions

Unless otherwise specified, the following terms in these Terms of Use have the meanings as follows:

1. Account refers to data about the User, which must at minimum include a username, password, phone number, and email, required to be filled in by Registered Users.
2. Terms of Use is the agreement between the User and Tokogame.com containing a set of rules governing the rights, obligations, responsibilities of the User and Tokogame.com, as well as the procedures for using the Tokogame.com Service system.
3. Tokogame.com Payment System is a payment system facilitated by Tokogame.com to enable Users to conduct transactions on the Tokogame.com System.
4. Personal Data/Information refers to data related to a User that can be identified and/or identifiable individually or in combination with other information, either directly or indirectly, through electronic and/or non-electronic systems.
5. Services collectively include: (i) the Tokogame.com System; (ii) any content, features, services, and functions available on or through the System by or on behalf of Tokogame.com, including Partner services; and email notifications, buttons, widgets, promotions, and advertisements, including Tokogame.com’s collaborations with third parties for application development and business activities.
6. Partner refers to parties collaborating with Tokogame.com to support the Tokogame.com System and Services, including payment service providers, voucher providers, network providers, and others.
7. User refers to any party (registered or unregistered) accessing the Tokogame.com System, including but not limited to Buyers, offline users, and clients, who must comply with the Tokogame.com Terms of Use and other applicable terms, including but not limited to the Tokogame.com Privacy Policy.
8. Buyer refers to registered or unregistered Users who perform direct top-ups or purchase vouchers sold by the Tokogame.com System and must comply with the Tokogame.com Terms of Use and other applicable terms, including but not limited to the Tokogame.com Privacy Policy.
9. Tokogame.com System refers to the official website www.tokogame.com or other systems or facilities accessible via a User’s computer and/or mobile device, including Affiliates and third parties collaborating with Tokogame.com.

Services

• Tokogame.com manages and provides the System and Services for Users to purchase direct top-ups or vouchers sold by Tokogame.com. Once a Buyer has completed a purchase of a top-up or voucher in accordance with the Tokogame.com Terms of Use, the Buyer is responsible for the purchased top-up or voucher.
• Tokogame.com provides and operates a system or platform for selling virtual products, where the products sold are direct top-ups or vouchers usable by Buyers.
• Tokogame.com shall not be liable if you incur losses in your business as a Buyer due to negligence or errors such as incorrect order entry or other data inaccuracies.
• Tokogame.com does not accept cancellation or refund requests after an order has been entered into the Tokogame.com System. Tokogame.com may provide a 100% refund if an order cannot be completed in accordance with applicable terms.

Disclaimer

• By accessing and using our services, users understand and agree that:
• 1️⃣ We act solely as an intermediary in the digital game item trading process and are not officially affiliated with the respective game developers or publishers.
• 2️⃣ We are not responsible for how purchased items are used, including but not limited to violations of game policies, government regulations, or any activities that could be categorized as illegal, such as online gambling.
• 3️⃣ All risks related to item usage are the full responsibility of the buyer, including cases where items are removed by the game provider, accounts are penalized, or the game’s policies change.
• 4️⃣ We reserve the right to cancel or terminate transactions if any violation of applicable laws or game policies is detected.
• 5️⃣ We do not sell or facilitate transactions that violate the law, including but not limited to items that can be used for betting, gambling, or other illegal activities. If we receive reports or warnings from regulators or game developers, we reserve the right to immediately remove the relevant items from our platform.
• 6️⃣ By conducting transactions on this platform, users declare that they have fully understood and agreed to all applicable terms and conditions without coercion.

Payment System

Tokogame.com collaborates with official Payment System Service Providers (Banks and Non-Banks) supervised by Bank Indonesia and the Financial Services Authority to provide a payment system that facilitates and secures every transaction conducted on the Tokogame.com System for Users.

Payment methods available through the Tokogame.com System include:

2. Virtual Account
3. In-store Payment (Offline Retail Payment)
4. Internet Banking
5. Direct Debit
6. Electronic Money
7. Credit Card

Users

Mandatory requirements for Users to access Services on Tokogame.com include:

• Users under 18 years of age must obtain consent from a parent or guardian to use and/or access Services on Tokogame.com and are responsible for all costs arising from the use of Services on Tokogame.com.
• Users must read, understand, and comply with all provisions outlined in these Terms of Use.
• Users with a Tokogame.com account must provide complete and honest personal data in accordance with their identity on the Tokogame.com profile page.
• Users must provide true, clear, honest, accurate, complete, and up-to-date information about themselves for the purpose of using Tokogame.com from time to time.
• Users must understand that their account details are confidential and therefore must not disclose account details or User information to any Third Party. Tokogame.com will not request a User’s password. Users agree to bear all risks associated with disclosing their account information to any third party and are fully responsible for any consequences arising therefrom.
• Users are prohibited from using robots, spiders, processes, or means to access the Services for any purpose, or any other automated devices, including but not limited to monitoring or copying any material on the Tokogame.com System or Services.
• In the event Users report and/or file complaints regarding the Services on Tokogame.com and/or these Terms of Use, such reports and/or complaints must be submitted in good faith and with the intent to resolve the issue.
• Users are prohibited from using Tokogame.com to violate regulations established by Indonesian law or any other country’s laws.
• While using and/or accessing any system or Services on Tokogame.com, Users are strictly prohibited from uploading and/or using words, comments, images, or any content containing elements of SARA (Ethnicity, Religion, Race, and Intergroup Relations), misleading information, defamation, discrimination, disparagement or targeting of others, disruption of public order, public unrest, vulgarity, threats, abusive language, or anything else deemed inconsistent with social values and norms or contrary to provisions set by ministries, institutions, or applicable laws and regulations.
• Users shall be fully responsible for all risks arising from the information they provide to Tokogame.com, including but not limited to matters related to Intellectual Property Rights, such as copyrights, trademarks, patents, trade secrets, industrial designs, and integrated circuit layout designs of a product.
• Users must respect the rights of other Users by not disclosing personal information to others without the consent of the relevant party.
• Users are prohibited from sending spam messages in any form referencing any features/services on the Tokogame.com System or Services for any purpose.
• Tokogame.com reserves the right, at any time and without prior notice to Users, to block the use of the system or services if a User violates applicable laws and regulations in Indonesia.
• Users are prohibited from using the Tokogame.com logo, images, or appearance in their profile photo (avatar), NFTs (Non-Fungible Tokens), or for other personal User purposes without prior consent from Tokogame.com.
• Users are prohibited from distributing viruses or other technologies that could harm Tokogame.com, the interests and/or property of Tokogame.com Users, or government institutions.
• Users are deemed to be aware of all laws and regulations applicable in the Republic of Indonesia in every transaction on Tokogame.com and shall not engage in any actions that violate Indonesian laws and regulations.
• Should any violation of these Terms of Use by a User be discovered at a later date, Tokogame.com reserves the right to take actions deemed necessary to maintain the security and comfort of other Users and the Tokogame.com System.
• Users shall be fully responsible for all content they upload, send via email, transmit, and/or provide through the Tokogame.com System or Services.
• Users hereby declare that Tokogame.com is not responsible for any losses or issues arising from misuse of the User’s account due to the User’s negligence, including but not limited to lending or granting account access to others, accessing links or connections provided by others, disclosing or showing passwords or emails to others, or other User negligence resulting in losses or issues with the User’s account.
• Users hereby declare that Tokogame.com is not responsible for any losses or issues arising from the User’s actions.
• For User security, Tokogame.com recommends that Users periodically change their password to maintain account confidentiality.
• Users guarantee that the identity/personal data registered during account creation on Tokogame.com belongs to the User and not to any other party.
• Users shall cooperate with Tokogame.com at all times to investigate and determine whether there has been a violation of these Terms of Use by granting Tokogame.com (and its designated parties and independent auditors) access rights to the User’s personal data and/or devices used to access the Tokogame.com System. In this regard, Users authorize Tokogame.com to collaborate with authorities (including but not limited to police, government agencies, telecommunications providers, internet service providers, data center providers, and others) without prior User consent.
• Users guarantee they will not take any actions that could affect, diminish, or disrupt the services, software, hardware, systems, or networks used by other Users to access the Tokogame.com System.
• Users guarantee they will not take any actions that could disrupt and/or negatively impact Tokogame.com or cause detrimental effects to the sustainability of Tokogame.com’s business activities.
• Users are prohibited from using Tokogame.com Services to impersonate or fraudulently represent themselves as another person/party unlawfully to mislead and/or deceive others, whether intentionally or unintentionally.
• Users are prohibited from using the Tokogame.com System to collect personal data of Users for purposes that violate the Tokogame.com Privacy Policy and applicable Indonesian laws and regulations.
• In the event of a violation of these Terms of Use or other Tokogame.com terms and conditions, Tokogame.com reserves the right to take necessary actions, including but not limited to content removal, account blocking, transaction cancellation, refunds, and other measures.
• Tokogame.com Users must provide their personal bank account details for transaction purposes on Tokogame.com.
• Beware of fraud attempts claiming to represent Tokogame.com.

Transactions

• Users must conduct transactions following the transaction procedures established by Tokogame.com. Buyers make payments using the payment method previously selected by the User on the Tokogame.com System. Users must not disclose their payment data/information to any party during payment.

• When making purchases on the Tokogame.com System, Users agree that:

  1. Users are responsible for reading, understanding, and agreeing to the information and descriptions of all products (including but not limited to quantity, value, usage, function, etc.) before committing to purchase the product.
  2. Users enter into a legally binding agreement to purchase or pay for direct top-ups or vouchers when they perform a direct top-up transaction or purchase a voucher.

• Users understand and agree that product availability is the responsibility of the Partner. If a product is out of stock, the Partner will reject the order, and the purchase payment will be refunded to the User.
• Users understand and agree that any transactions conducted outside the official Tokogame.com system and/or without Tokogame.com’s knowledge (e.g., through private networks, messaging, purchases outside Tokogame.com, and/or payments not invoiced by Tokogame.com) are the personal responsibility of the User.
• Users understand and agree not to submit or disclose proof of transactions conducted on Tokogame.com to any party other than Tokogame.com through official Tokogame.com communication channels. If losses occur due to submitting or disclosing transaction proof to another party, such losses are the responsibility of the Buyer.
• Users understand and agree that any claims filed after confirmation/automatic confirmation of product receipt are not the responsibility of Tokogame.com. Losses arising after confirmation/automatic confirmation of receipt are the responsibility of the respective User.
• Users understand and agree that delays in payment processing and additional fees caused by differences between the User’s bank and Tokogame.com’s official bank account are the personal responsibility of the User.
• Users hereby agree that Tokogame.com, at its discretion, may impose additional fees on transactions on the Tokogame.com System at any time.
• Users fully understand and agree that any transactions conducted between Users and Tokogame.com, other than through Tokogame.com’s Official Account and/or without Tokogame.com’s knowledge (e.g., through private facilities/networks, messaging, special transaction arrangements outside the Tokogame.com System, or other means), are the personal responsibility of the User.
• Users must transfer funds according to the total transaction amount within the timeframe specified in the Tokogame.com System. If the User fails to transfer funds within the specified time, the transaction will be automatically canceled.
• Every transaction on Tokogame.com using the transfer method will incur a service fee in the form of a unique payment code to facilitate verification. Tokogame.com is not responsible for losses incurred by Users if payments are made that do not match the invoiced amount displayed on the payment page.
• If a User conducts unofficial transactions or engages in fraudulent activity, Tokogame.com reserves the right to pursue legal action.
• Users must take responsibility for their errors or negligence.

Refunds and Fund Disbursement

• If an order cannot be processed due to incorrect data provided by the customer, the order will be refunded in the form of credit as a discount code usable for the next order. For erroneous BCA bank transfers, we will require time for verification and will refund the amount with an administrative fee: - Below IDR 100,000: IDR 5,000 administrative fee - Above IDR 100,000: 5% administrative fee with a maximum of IDR 100,000.
• If a refund is issued to a User for any reason, Tokogame.com will return the transaction funds according to the User’s payment method, minus service fees, unless otherwise determined by Tokogame.com. Costs related to transferring refund funds to the User’s account are borne by the User.
• Tokogame.com, at its sole discretion, may issue refunds to Users to protect against risks and losses if Tokogame.com concludes that a User’s actions indicate fraud, abuse in transactions, and/or violations of the Tokogame.com Terms of Use, or if the User’s account is suspected or confirmed to have been accessed by another party. Costs arising from such User actions are the responsibility and liability of the User.
• Funds will be transferred to the User’s account within 8x24 hours.
• Tokogame.com reserves the right to conduct reviews, freeze, delay, and/or cancel fund disbursement transactions performed by Users if there is evidence of violations of Tokogame.com’s terms and conditions, fraud, manipulation, deception, and/or criminal activity.
• Reviews, freezes, delays, and/or cancellations of User fund disbursement transactions by Tokogame.com may be conducted for as long as necessary.

User Data

• Users hereby agree that Tokogame.com may collect, use, access, store, and/or process User data, including but not limited to personal information, conversation content, and/or information about the User’s use of services on the Tokogame.com System.
• To the extent permitted by applicable law, Tokogame.com (including affiliated companies and official partners collaborating with Tokogame.com) has the right to use all or part of the data obtained and collected from Users through the Tokogame.com System for the purpose of development and quality improvement to enhance User security and comfort.
• Tokogame.com reserves the right to disclose User data for legal proceedings and/or requests from government institutions, law enforcement, and other officially authorized parties as stipulated by applicable Indonesian laws and regulations.

Promotions

1. Tokogame.com may hold promotions from time to time with terms and conditions determined by Tokogame.com. These terms and conditions may vary for each promotional activity. Users are required to carefully read and understand the terms and conditions of each promotional activity from time to time.
2. Tokogame.com reserves the right to cancel transactions related to promotions at any time without prior notice for the comfort of other Users and security reasons.
3. Tokogame.com reserves the right to amend the terms and conditions of any promotional activities organized by Tokogame.com from time to time without prior notice to Users.

Applicable Law and Dispute Resolution

This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of Indonesia, without regard to conflicts of law principles. Users agree that any legal action or dispute arising from, relating to, or in any way connected with the Tokogame.com System and Services and/or these Terms of Use shall be resolved exclusively through BANI (Indonesian National Arbitration Board), established on November 30, 1977, based on the Indonesian Chamber of Commerce Decision No. SKEP/152/DPH/1977, whose rules are deemed incorporated into these provisions.

Indemnification

Users agree to release Tokogame.com from claims for damages and to indemnify Tokogame.com (including its affiliates, directors, commissioners, officers, employees, and agents) from any claims or demands, liabilities, losses, and reasonable legal costs made by Third Parties arising from User errors, including but not limited to violations of these Terms of Use, improper use of Tokogame.com Services on the Tokogame.com System, infringement of third-party rights, violation of the Tokogame.com Privacy Policy, and/or User violations of applicable Indonesian laws and regulations.

Termination/Modification of Services and Third-Party Services

• Tokogame.com (including its affiliates, directors, commissioners, officers, employees, and agents) is not responsible, and Users agree not to hold Tokogame.com liable, for any damage or loss (including but not limited to loss of money, reputation, profits, or other intangible losses) resulting directly or indirectly from the use of third-party services accessed through the Tokogame.com System. Users are advised to carefully read the terms of use and other conditions provided by each respective third party.
• Tokogame.com reserves the right to modify, suspend, or terminate services and/or third-party services from time to time without User consent or prior notice.

Disclaimer of Warranties and Limitation of Liability

• Tokogame.com will strive to maintain the quality of Tokogame.com services to remain safe, comfortable, and fully functional, but Tokogame.com cannot guarantee continuous operation or perfect access to the Tokogame.com System. Information and data on the Tokogame.com System may not always be real-time.
• If a User has a dispute with one or more other Users, the User releases Tokogame.com (including its parent company, affiliates, commissioners, directors, and/or employees) from claims and demands for damages and losses (actual and consequential) of any kind and nature, known and unknown, arising from or in any way related to such disputes. Accordingly, Users intentionally waive any legal protections (contained in laws or other legal regulations) that would limit the scope of this release.
• Users agree and acknowledge that they use the Tokogame.com Services on the Tokogame.com System at their own risk, and the Tokogame.com Services are provided to Users “as is” and “as available.”

• To the extent permitted by applicable law, Tokogame.com (including its affiliates, directors, commissioners, officers, employees, and agents) is not liable, and Users agree not to hold Tokogame.com liable, for any damages or losses (including but not limited to loss of money, reputation, profits, or other intangible losses) resulting directly or indirectly from:

  1. The use or inability to use the Tokogame.com System;
  2. Prices, quantities, or other instructions available on the Tokogame.com System;
  3. Delays or disruptions in the Tokogame.com Services;
  4. Negligence and losses caused by individual Users;
  5. Disputes between Users;
  6. Defamation of others;
  7. Misuse of products available on the Tokogame.com System purchased by Users;
  8. Losses due to unauthorized payments to parties other than Tokogame.com’s official account, claiming to represent Tokogame.com, or due to errors in account details and/or other information and/or bank negligence.
  9. Viruses or other malicious software (bots, scripts, automation tools) obtained by accessing or connecting to the Tokogame.com Services.
  10. Disruptions, bugs, errors, or inaccuracies in the Tokogame.com Services.
  11. Damage to the User’s hardware from using any Services on the Tokogame.com System.
  12. Hacking actions by third parties on the User’s account.
  13. Failures and/or disruptions in implementing new technologies and/or systems in the User’s devices and/or internet network.
  14. Network disruptions on Tokogame.com resulting in server downtime, requiring emergency maintenance and/or repairs to the Tokogame.com System.
  15. Account misuse due to User negligence, including but not limited to lending accounts to others, granting password access to others, providing authentication codes to others, accessing links or connections from others, or other User negligence causing losses or issues with the User’s account.
  16. Unavailability of Services on the Tokogame.com System at any time or for an indeterminate period due to circumstances beyond Tokogame.com’s control.

Updates and Modifications to Terms of Use

Tokogame.com reserves the right to update and/or modify these Terms of Use from time to time as necessary for the security and convenience of User transactions on the Tokogame.com System. Users hereby agree that they are responsible for carefully reading and reviewing these Terms of Use periodically to stay informed of any updates and/or changes. By continuing to access and use the Services on the Tokogame.com System, Users are deemed to agree to the updates and/or changes in these Terms of Use.
